1. GENERAL

References to ‘we’, ‘us’ or ‘our’ are references to LS Travel Retail New Zealand Limited. Contract means your Order of a Product.

Order means the order submitted by you on the site.

You means you the Customer.

Product(s) means the product selected from our Site.

Site means our online store www.aelia.co.nz

This website is owned and operated by Ls Travel Retail New Zealand Limited.

We have provided this website for your use, subject to the Terms & Conditions listed below. Please read these carefully. By using our website, you agree to be bound by these Terms & Conditions.

2. ABOUT YOU

In order to purchase products from us, you must be over 18 years of age and have a valid credit or debit card issued by a bank acceptable to us that you are authorised to use. You must log in, either with your own details or as a guest, and provide us with your full name and address for log-in details

When placing an Order you undertake that the details that you provide to us, like your name, address and contact phone number and email, are true and accurate.

When you place an order on our website, you are making an offer to buy the goods and/or services. When you place an order, you will be required to provide details to enable us to fulfil and deliver the order to you.

3. ACCEPTANCE 

When making an Order you must follow the instructions on the Site. Once you have selected a product and entered your delivery address, the Site will display the invoiced amount (including GST) and any delivery charges.

When you place an Order you will receive an acknowledgement email confirming receipt of your Order. Your Order remains valid as an offer and a Contract between us will only be accepted by us when your payment has been approved and your credit or debit card has been debited.

A Contract shall then be formed, and we shall then be legally bound to supply the Product(s) to you.

4. ORDER MISTAKE

If you discover that you have made a mistake with your Order after you have submitted it, please contact us immediately at service@aelia.co.nz. We cannot guarantee that we will be able to amend your order.

5. PRODUCT AVAILABILITY

Products displayed on our website are subject to availability in our online store.

We may cancel the Contract if the Product is unavailable. We will notify you by email of the unavailability and return your payment.

7. CANCELLATION

If you wish to cancel your order please contact service@aelia.co.nz. No cancellation fees will apply unless the item has been dispatched and it must be returned to us at your cost.

Once your order is confirmed we are unable to change or cancel any aspects of your order.

Please carefully check your order details before completing payment of the order. In order to protect our customers and services, we reserve the right to cancel orders or request other methods of payment for orders received.

In the unlikely event that the goods or services ordered are no longer available we reserve the right to refuse or cancel an order.

We reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to be placed for commercial purposes, e.g. any kind of reseller. We also reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to have been placed fraudulently.

While we endeavour to ensure that the price and description of goods or services is accurate, if there is an error in the process of listing a product or service on our website or a technical error in the processing of your order we reserve the right to refuse or cancel the order.

Our right to cancel orders applies to orders that have been accepted.


8. FAULTY PRODUCTS 

Our Products may come with guarantees that cannot be excluded under the New-Zealand Consumer Law. If you believe the Product is faulty, then please contact us as service@aelia.co.nz. Please include as many details as possible about the order including order number, the Product and details of the defect. We limit our liability to either repair or replace the Product as per our Return Policy.

9. INTELLECTUAL PROPERTY 

The intellectual property rights in all software and content made available to you on or through the Site remains our property or licensors. The intellectual property is protected by intellectual property laws and treaties and we reserve our rights to rely upon these laws and treaties. You may store, print and display the content for your own personal use. You must not publish, manipulate, distribute or otherwise reproduce any of the content or copies of the Website’s content including any unauthorized use of our trademarks.

10. OTHER WEBSITES

Our Site may contain links to third party websites. These linked websites are not under our control and we are not responsible for the content of those websites nor are those websites subject to our Privacy Policy. Before disclosing your personal information on any other website, we recommend that you examine the Terms & Conditions and privacy policy of the relevant website. We are not responsible for any practices on linked websites, or actions taken by you on linked websites that might breach your privacy.

11. FORCE MAJEURE 

We will not be liable to you for any breach or delay in the performance of the Contract due to any cause beyond our reasonable control including but not limited to natural disaster, actions of third parties, riot, war, national emergencies, terrorism, strikes fire, explosion, storm, flood, drought, earthquake, natural disaster, and failure of public utility services or transportation services.

12. LIMITATION ON LIABILITY

To the extent permitted by law, we are not liable for any express or implied guarantees, warranties, representations, or other Terms & Conditions. However, nothing in these Terms & Conditions excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition imposed by legislation, including the New Zealand Consumer Law, which cannot be lawfully excluded. 

To the maximum extent permitted by law: 

We exclude all warranties, descriptions, representations or conditions in relation to the goods and/or services provided by us implied by law, trade, custom or otherwise, where goods are advertised with reference to photograph(s) we will endeavour to deliver the corresponding goods, however we do not warrant that the goods we deliver to you will be identical to those displayed in the photograph(s). 

Our liability for any claim, damages, loss or expense related to the supply by use of goods or services is limited to the cost paid by you for such good or services. 

We will not be liable, whether in contract, tort (including negligence) or otherwise for any indirect, consequential or special loss or damage, or loss of profits, loss of data, loss of savings and loss of opportunity.

13. INDEMNITY

You agree to indemnify, hold harmless and defend us, including our directors, employees, consultants, agents from any and all third party claims, liability, damages and/or costs arising from your misuse of this website or your breach of these Terms & Conditions.

14. VARIATION 

We reserve the right to amend these Terms & Conditions at any time.

15. INVALIDITY

If any clause in these Terms & Conditions or a Contract shall become or be declared to be invalid or unenforceable, such invalidity or unenforceability shall in no way affect any other clause or part of any clause, which shall remain in full force.

16. GOVERNING LAW

This website is governed by, and is to be interpreted in accordance with, the laws of New Zealand.

These Terms & Conditions and Contract shall be governed and construed in accordance with the laws of New Zealand.

 17. LIQUOR LICENSE

Pursuant to the Sale and Supply of Alcohol Act (the Act), DUTY FREE STORES WELLINGTON LIMITED (the licensee) is authorised to sell and supply alcohol, on the premises situated at 7 Ron Guthrey Road, Christchurch, and known as "AELIA DIRECT, to any person for consumption off the premises and to supply alcohol free, as a sample, for consumption on the premises. The authority conferred by this licence must be exercised through a manager or managers appointed by the licensee in accordance with Subpart 7 of Part 2 of the Act.

All prices are stated in New Zealand dollars inclusive of goods & services tax (GST). Alcohol is supplied under our licence 60/OFF/55/2021. In order to purchase alcohol you must be over 18 years old and legally entitled to do so. The licence expires on the 30th day of June 2022, unless again renewed.
